54.   Immunity

  1.  

    (1)   No action or proceeding lies or shall be commenced against the Crown, the Minister or any authorized person for anything done, caused or permitted or authorized to be done, attempted to be done or omitted to be done in good faith under this Act or the Regulations by that person unless that person is grossly negligent or reckless —

    1.  

      (a)     in the exercise or purported exercise of any power conferred by this Act or the Regulations; or

    1.  

      (b)     in the carrying out or purported carrying out of any order made under this Act or any duty imposed by this Act or the Regulations.

    (2)   In this section, “authorized person” means a person acting under the authority of this Act or the Regulations.
